Terms and Conditions

ARTICLE 1 : OBJEcT

The general conditions of sales described hereafter detail the rights and obligations of the company  Carolina Cake, whose head office is located 9 boulevard du Général Leclerc 06240 Beausoleil, registered in the Trade and Companies Register under the number 895 329 076 Nice B, and its customers within the framework of its activity of cake designer. Any service accomplished by the company  Carolina Cake implies the adhesion without reserve of the buyer to the present general conditions of sale.

ARTICLE 2 : DEPOSIT AND PAYMENT

Any order once validated is firm and final.

For orders under 150€: The order will be validated after receipt of the full amount of the order.

For orders over 150€: The order will be validated only after reception of a deposit of 50%.

This deposit is not refundable under any circumstances (customization, materials, ingredients and labor costs are incurred).

The balance of the order must be paid one week before the date of the event.

The following payment methods are accepted:

  • Cash
  • Credit card
  • Remote sale by CB
  • Monaco check for amounts less than 100€.

ARTICLE 3: CANCELLATION AND REFUND

In case of full payment of your order, 50% of the order amount can be refunded if the cancellation is made 2 weeks before the date of the event.

Weather conditions or illness are not grounds for cancellation or postponement.

ARTICLE 4: ALLERGIES

The customer undertakes to mention precisely any allergy so that none of the allergens mentioned by the customer are used during the realization of the order.

ARTICLE 5: TRANSFER OF RISK

As for the more traditional pastries, after delivery of the cake to a given point, the customer is entirely responsible for its transport in good conditions, and for its good conservation afterwards.

ARTICLE 6: DESIGN OF THE CAKE

 Carolina Cakewill closely follow the Customer’s requests to create the exact cake desired.

 Carolina Cake cannot reproduce an exact copy of another baker’s work, but will ensure that it looks similar.

For reasons of hygiene and food safety, no additions of any kind (flowers, plastic figurines, cake topper…) may be made to the cake by the customer after delivery of the cake without prior authorization from Carolina Cake.

ARTICLE 7: DELIVERY

Delivery is an additional service and is subject to availability. Deliveries are only possible between 10:30 a.m. and 6:00 p.m., and the desired time slot must be communicated at the time of ordering or as soon as possible to facilitate planning for both parties.

It is expressly agreed that the customer must imperatively inform Carolina Cake of any difficulties to be foreseen in the delivery (difficult or impossible parking in front of the place of delivery, difficulties of access, stairs, damaged or excessively steep paths…). These may result in an increase in the delivery price. Carolina Cake will not be held responsible for damages caused to the order during the delivery if all these information have not been communicated beforehand.

ARTICLE 8: LIABILITY

 Carolina Cake declines all responsibility if, after delivery or collection of the order:

Fresh flowers or any other decorative objects not suitable for food contact are added to the cake.

Shipping and storage instructions are not followed.

Carolina Cake will not be held responsible for any damage caused directly or indirectly by the customer or a third party to the order, once collection or delivery has been made.

Carolina Cake will not be held responsible for the customer’s failure to comply with the cutting plan. The customer is informed of the total order quantity and is provided with a detailed cutting plan on the day of collection or delivery.

Carolina Cake will not be held responsible for improper storage of the order. Store the order in a refrigerated and ventilated area, away from air and humidity. Carolina Cake informs the customer that the preparation of this type of order requires the use of certified food contact but non-edible accessories, such as dowels, floral wire, etc.

Carolina Cake recommends that the customer remove the decorative elements before cutting and eating.

ARTICLE 9: CANCELLATION BY CAROLINA CAKE

The total or partial cancellation of the order by Carolina Cake will be expressly considered as a case of force majeure. For this reason, the force majeure means any external, unforeseeable and irresistible event in the sense of the article 1148 of the Civil code.

 Carolina Cake will then reimburse the customer for all sums paid on the date of cancellation, but will not be required to pay any compensation due to the cancellation of the order, the customer already waiving any action for liability of the company for the purpose of obtaining damages on these grounds.

During the validation of the order, the customer commits himself to have taken knowledge of the CGV.
